3.Information we process because we have a legal obligation

We are subject to the law like everyone else. Sometimes, we must process your information in order to comply with a statutory obligation.

4.Information relating to your method of payment

Payment information is never taken by us or transferred to us either through our website or otherwise. Our employees and contractors never have access to it.

At the point of payment, you are transferred to a secure page on the website of SagePay or PayPal. That page may be branded to look like a page on our website, but it is not controlled by us.

5.Information about your bank transfer

When you agree to pay by bank transfer, the information you give to us confirmation that you have made the payment with our invoice no. as your reference.  We access our bank account Barclays Bank Plc to match your payment amount with your reference. We do not see or keep copies of any information relating to your bank other than our own company bank statements.

6.Job application and employment

If you send us information in connection with a job application, we may keep it for up to 3 months in case we decide to contact you at a later date.

If we employ you, we collect information about you and your work from time to time throughout the period of your employment. This information will be used only for purposes directly relevant to your employment. After your employment has ended, we will keep your file for six years before destroying or deleting it.

7.Sending a message to our support team

When you contact us, whether by telephone, through our website or by e-mail, we collect the data you have given to us in order to reply with the information you need.

We record your request and our reply in order to increase the efficiency of our business.

We keep personally identifiable information associated with your message, such as your name and email address so as to be able to track our communications with you to provide a high quality service.

When we receive a complaint, we record all the information you have given to us in order to comply with trading standards and consumer law.

We use that information to resolve your complaint.

Although we do not disclose your personal information to any third party (except as set out in this notice and for the purpose of gaining trade references and credit searches for customers wishing to open a trade credit account), we sometimes receive data that is indirectly made up from your personal information from third parties whose services we use, this could be a courier service or a business reference request.

To assist in combating fraud, we share information with credit reference agencies, so far as it relates to clients or customers who instruct their credit card issuer to cancel payment to us without having first provided an acceptable reason to us and given us the opportunity to refund their money.

Wholesale Terms & Conditions

 

The terms and conditions outlined below govern the use of our website and our business; by using our website you agree to be bound legally by these conditions.  The Customer is deemed the buyer/person placing the order and/or the name of the account holder and will be bound by these terms and conditions.

Any agreements made between Laval Cosmetics and the Customer will be made in writing and Laval Cosmetics reserve the right to cancel any such agreements if the terms of the agreement are not met.

Any errors and/or omissions in any form of verbal of typographical information relating to sales material, prices/price lists, quotations, website, correspondence or any other documentation or information will be subject to correction without liability to Laval Cosmetics.

Once an order has been placed by the Customer and accepted by Laval Cosmetics it cannot be cancelled unless notice has been given in writing.  Laval Cosmetics reserve the right to charge the Customer any processing/labour costs that may have been incurred in preparing the order since accepted.  Orders cancelled within 24 hours of the scheduled collection from the courier may be liable for an administration charge.

The terms set out by Laval Cosmetics both in this document and on this website are governed by English law, any claims or disputes will be under the jurisdiction of the English Law Courts.

Laval Cosmetics reserve the right to make amendments/changes to the terms and conditions as set out in this document.

Customers may apply for a credit account, once they have traded successfully with Laval Cosmetics for a set period of time as deemed acceptable by Laval Cosmetics; trade references and credit searches may at this time be requested and sought by Laval Cosmetics as provided by the Customer in compliance with the application to open a trade account.

Use of the Website 

Laval Cosmetics reserve the right to refuse access to the website, cancel or amend orders at their discretion should the justification arise.

Laval Cosmetics reserve the right to remove or edit content, including prices as and when the need arises to meet business needs and continuity. 

The Customer is solely responsible for submitting the correct information for their account and must contact Laval Cosmetics with any changes relating to delivery and billing address and contact details immediately.  Laval Cosmetics will not be held liable for errors occurring with deliveries or communications if information is not updated on the Customers’ account.

The Customer agrees to maintain the confidentiality of their account and password and to all responsibilities in relation to your account.

No part of this website may be replicated for the Customers’ own business without prior written agreement from Laval Cosmetics.

Should the Customer, or its employees or partners, use this website and conduct business with Laval Cosmetics in a way that causes a detrimental impact, damage or disruption to the business, products and trading name of Laval Cosmetics, or fraudulent activity then the Customers’ account will be terminated and legal action will be taken.

The Customer must not breach any privacy, copyright, trademark rights nor send cause any form of third party injury in any form including and notwithstanding offensive, violent, criminal material, viruses, malware and any form of spam.  Anyone found attempting to obtain access to secure areas of our system will have their account closed and legal action will be taken.

Prices

All prices shown are in £ Sterling (GBP) and are shown as net, VAT will be applied to all orders at the rate of 20%. 

There is a minimum order value of £250 on wholesale UK orders.

Laval Cosmetics reserves the right, by giving notice to the customer before delivery, to increase the total price of the order to reflect any increase in cost due to external factors beyond Laval Cosmetics control such as (price increase in manufacturing, raw materials, exchange rates, duty charges and any other third party charges).  This may also include any additional charges/price increases relating to delivery due to changes made by the Customer.

Payment 

Payments are to be made online via secure payment gateway with Sagepay® or PayPal® using a credit or debit card.

Laval Cosmetics reserves the right to activate additional security measures, request additional identification if the need arises and cancel orders to eliminate the risk of fraudulent transactions. 

Laval Cosmetics reserves the right to cancel any credit/debit card payments that have left the Customer’s account and are shown by the payment provider as ‘pending’ such payments are not classed as cleared funds and have not been paid to Laval Cosmetic’s account.  In such circumstances, the Customer will be contacted and advised to contact their bank and/or the payment provider to ascertain they payment can be authorised.  Laval Cosmetics will offer the option of a bank transfer for any credit card payments that are declined, pending and subsequently cancelled or declined by the payment provider.  Laval Cosmetics apologise for any inconvenience if this was to occur but security is paramount.

Should the Customer fail to make any payments on the due date then Laval Cosmetics are entitled to suspend any further deliveries to the Customer, any unpaid amounts may be charged interest at a monthly charge of 1% above Bank of England base rate until the outstanding amount is paid in full.

Delivery

Orders will be delivered free of charge to a mainland UK deliverable address as stated on the application for a trade account form; PO Boxes are not accepted.  Laval Cosmetics reserve the right to deliver the order to the billing address of the credit/debit card used. 

Should the Customer fail to take delivery of the order or provides incorrect delivery details then Laval Cosmetics will not be held liable for any charges relating to redelivery of the order.

Orders will not be dispatched until funds have cleared our bank account.  Any credit/debit card payments that have left the Customer’s account but have not been received by Laval Cosmetics and are held by the payment provider as ‘pending’ are not classed as cleared funds and may be cancelled and a bank transfer requested or additional identification requested.

Any orders received of an evening, during the weekend or on a bank holiday will be classed as received on the next working day.

The order/goods will remain the property of Laval Cosmetics until the value of the order is received in full.  Orders purchased via a credit account remain the legal property of Laval Cosmetics, once paid in full the title of the goods transfers to the Customer. 

The Customer must ensure the products in the order are insured against loss or damage with a reputable insurance company and state Laval Cosmetics’ interest to any Laval products on such insurance policies in relation to the credit facility granted to the Customer. 

Laval Cosmetics will not be liable for any delay that may affect the Customers business if the delay is outside of Laval Cosmetic’s control such as: an act of god, tempest, storm damage, flood, fire, theft, accident, war or threat of war, terrorism, civil unrest, sabotage, regulatory laws, government or local authority restrictions, industrial action, embargoes, manufacturing issues including raw materials, labour, fuel, machinery, power supplies and any other external force or force majeure.

Returns

Goods are not supplied on a sale or return basis, however the return of non-faulty goods is allowed in compliance with the Consumer Contract Regulations, after agreement in writing from Laval Cosmetics, goods must be in the original condition and packaging with no seals broken and in a re-sellable condition. Once a satisfactory inspection has taken place an exchange will be made or a refund will be credited to the Customer’s card or account.  The Customer has 7 days from the delivery date (or if the fault is not detected on reasonable visual inspection 30 days) to return/cancel orders, after this period orders Laval Cosmetics reserves the right to charge a 10% administration fee for unwanted orders that are returned that are not faulty, charges are at the discretion of Laval Cosmetics.  The customer should contact Laval Cosmetics in writing immediately reporting any faulty items with images or details of incorrect orders to arrange returns.

Laval Cosmetics will not be liable to the Customer (other than personal injury due to negligence) for any representation, implied warranty, condition, consequential loss or damage including loss of profit or other losses, costs, expenses or other claims for consequential compensation whatsoever. 

Stock Availability

All stock is subject to availability.  When an order cannot be fulfilled we will contact the customer to inform them and ascertain whether they wish their order to be dispatched and to receive the remainder of their order when it is back in stock, whether they wish to wait for the full quantity or order to be dispatched if the wait time is short or whether a refund is required.

The Images on this website are the property of Laval Cosmetics, they are for illustration purposes.  We endeavour to ensure the shades are as close as possible to the products in the images, however colours may differ slightly from the actual product.

Intellectual Property

No licence is granted to the Customer in these Terms and Conditions to use any trade mark of Laval Cosmetics or to act on behalf of the company. 

Privacy Policy/GDPR

Laval Cosmetics value their Customers’ privacy and do share or sell any Customer details to third parties.  The information that Laval Cosmetics hold on the Customer and the company will be used in compliance with the GDPR, please see our privacy policy for full details.  Customer Card payments are processed direct by ProTX/SagePay® or PayPal® depending on the option chosen by the Customer and therefore Laval Cosmetics do not have access to any of the Customer’s card details or any additional personal information used in making the payment.  The information retained by Laval Cosmetics is solely to conduct business with the Customer in conjunction with the information provided on the ‘Application for a Trade Account’ form.

Bankruptcy/Insolvency

Should the Customer make a voluntary claim with its creditors, enter into administration, bankruptcy, liquidation, be part of a merger, acquisition or takeover, ceases trading for any reason then the Customer agrees to notify Laval Cosmetics prior to any such action being taken by the Customer.  Any goods that have been delivered and not paid for remain the property of Laval Cosmetics and will be reclaimed in notwithstanding any previous agreements and all credit will be immediately void.

Export Terms & Conditions

Any agreements made between Laval Cosmetics and the Customer will be made in writing and Laval Cosmetics reserve the right to cancel any such agreements if the terms of the agreement are not met.

Once the Customer’s order has been packed Laval Cosmetics will contact the Customer with the weight and dimensions of the prepared goods in order that the Customer may contact their freight forwarder/courier to collect the goods from Laval Cosmetics at a mutually convenient time and within normal trading hours.  In no way shall Laval Cosmetics be accountable or held responsible for the shipment of the Customer’s order and will not be liable for any of the goods in transit once they have left Laval Cosmetics.

Laval Cosmetics reserves the right to activate additional security measures, request additional identification and if the need arises cancel orders to eliminate the risk of fraudulent transactions. 

Export Customers are unable to apply for a credit account.  Payment terms are strictly via bank transfer and funds must have cleared the bank account of Laval Cosmetics before orders will be released for dispatch.

Delivery

Once the Customer’s order has been paid in full, with cleared bank funds, the goods will be packed.  Laval Cosmetics will contact the Customer with the weight and dimensions of the prepared goods in order that the Customer may contact their freight forwarder/courier to collect the goods from Laval Cosmetics at a mutually convenient time and within normal trading hours.  In no way shall Laval Cosmetics responsible for the shipment of the Customer’s order and will not be liable for any of the goods in transit once they have left Laval Cosmetics.  Delivery/shipment is entirely the responsibility of the Customer.

It is the responsibility of the Customer to insure goods in transit from Laval Cosmetics to the Customer’s destination/delivery address.

Laval Cosmetics do not send hazardous goods (nail polish) to export Customers.

Any orders received of an evening, during the weekend or on a bank holiday will be classed as received on the next working day.   

The order/goods will remain the property of Laval Cosmetics until the value of the order is received in full.

The Customer must advise Laval Cosmetics, within acceptable time constraints, of any regulatory documentation that is required for export purposes to the destination. 

Laval Cosmetics are in no way liable for any export charges, taxes, duties, custom charges and/or any other costs related to the export of the goods in the Customer’s order.

Laval Cosmetics will not be liable for any delay that may affect the Customers business if the delay is outside of Laval Cosmetic’s control such as: an act of god, tempest, storm damage, flood, fire, theft, accident, war or threat of war, terrorism, civil unrest, sabotage, epidemic, pandemic, regulatory laws, government or local authority restrictions, industrial action, embargoes, manufacturing issues including raw materials, labour, fuel, machinery, power supplies and any other external force or force majeure.

Returns

Goods are not supplied on a sale or return basis, however the return of non-faulty goods is allowed in compliance with the Consumer Contract Regulations, after agreement in writing from Laval Cosmetics, goods must be in the original condition and packaging with no seals broken and in a re-sellable condition. Once a satisfactory inspection has taken place an exchange will be made or a refund will be credited to the Customer’s account.  The Customer has 7 days from the delivery date (or if the fault is not detected on reasonable visual inspection 30 days) to return/cancel orders, after this period orders Laval Cosmetics reserves the right to charge a 20% administration fee for unwanted orders that are returned that are not faulty, charges are at the discretion of Laval Cosmetics.  The customer should contact Laval Cosmetics in writing immediately reporting any faulty items, photographic evidence may be requested, or with full details of incorrect orders to arrange returns.

Laval Cosmetics will not be liable to the Customer (other than personal injury due to negligence) for any representation, implied warranty, condition, consequential loss or damage including loss of profit or other losses, costs, expenses or other claims for consequential compensation whatsoever. 

Stock Availability

All stock is subject to availability.  When an order cannot be fulfilled Laval Cosmetics will contact the Customer to inform them and ascertain whether they wish their order to be dispatched and to receive the remainder of their order when it is back in stock (a timeframe will be discussed), or whether they wish to wait for the full quantity if the wait time is short and acceptable, or whether a refund or substitution is required.

The Images on this website are the property of Laval Cosmetics, they are for illustration purposes.  We endeavour to ensure the shades are as close as possible to the products in the images; however, colours may differ slightly from the actual product.

Intellectual Property

No licence is granted to the Customer in these Terms and Conditions to use any trademark of Laval Cosmetics or to act on behalf of the company. 

Agency Rights

Laval Cosmetics reserve the right to cancel any such agencies at any time, giving the Agent one months notice in writing. 

Privacy Policy/GDPR

Laval Cosmetics value their Customers’ privacy and do not pass on or sell any Customer details to third parties.  The information that Laval Cosmetics hold on the Customer and the company will be used in compliance with the GDPR, please see our privacy policy for full details.  The information retained by Laval Cosmetics is solely to conduct business with the Customer in conjunction with the information provided on the ‘Application for an Export Account’ form.

Retail Terms & Conditions

Please read the terms and conditions carefully, by registering and placing an order the Customer agrees to our terms and conditions as set out below.  If you do not agree to the terms and conditions set out by Laval Cosmetics please discontinue use of this website immediately.  If you are under the age of 16 your parent/guardian must read and agree to the terms of this site.

Any errors and/or omissions in any form of verbal of typographical information relating to prices, website content, correspondence or any other documentation or information will be subject to correction without liability to Laval Cosmetics. 

Laval Cosmetics reserve the right to make amendments/changes to the terms and conditions as set out in this document and to remove and/or edit content, including prices as and when the need arises to meet our business needs and continuity and to accommodate any third party/manufacturer price increases.

The terms set out by Laval Cosmetics both in this document and on this website are governed by English law, any claims or disputes will be under the jurisdiction of the English Law Courts, however Laval Cosmetics reserve the right to instigate legal proceedings in any country in respect of the agreement/terms and conditions stated in this document.

As a Customer, you agree to maintain the confidentiality of your account and password and to all responsibilities in relation to your account.  The Customer is responsible for inputting personal data for purposes of delivery and contact information.  The Customer is responsible for updating their personal information should any of these details change and Laval Cosmetics will not be liable for any incorrect information held on the customer account which impacts negatively on a delivery of orders or communication.

No part of this website may be replicated without prior written agreement from Laval Cosmetics.  Should Customers use this website in a way that causes a detrimental impact, damage or disruption to the business, products and trading name of Laval Cosmetics, or fraudulent activity then your account will be terminated and legal action will be taken?

You must not breach any privacy, copyright, trademark rights nor send or cause any form of third party injury in any form including and notwithstanding offensive, violent, criminal material, viruses, malware and any form of spam.  Anyone found trying to obtain access to secure areas of our system will have their account closed and legal action will be taken.

Delivery 

Orders received Monday – Friday will be dispatched within 48 hours, however we attempt to process orders on the same day where possible, excluding Bank Holidays. Any orders received of an evening, during the weekend or on a bank holiday will be processed on the next working day where possible.

The maximum weight for overseas shipping is 2kg (per order).  Unfortunately, we do not ship Hazardous Goods (Nail Polish) overseas.

Laval Cosmetics may activate measures to request additional ID for high value orders to prevent potential fraud, any orders that we suspect to be fraudulent will be declined/cancelled.  We apologise for any inconvenience, but security is taken very seriously.

Returns

Unopened items in their original condition and packaging (with unbroken seals and in re-sellable condition) will be accepted for return with 14 days of receipt, the customer must also send an email to inform us at This email address is being protected from spambots. You need JavaScript enabled to view it..  Once a satisfactory inspection has taken place a full refund will be credited (less delivery charges).  Faulty items or incorrect orders should be returned in their original packaging with a letter stating the exact nature of the reason for return and detailing any faults/damage, photos may be requested. Faulty/incorrect orders must be returned within 14 days of receipt and an exchange or credit will be processed.  Returns should be sent to:

For EU/International orders, Laval Cosmetics will not be liable for any import or custom charges.

The products remain the responsibility of the Customer until they are received by Laval Cosmetics, we cannot be held responsible for any missing returns and we strongly advise customers to insure/send my tracked post.

Orders Not Received

We sincerely hope you receive your order on time and in perfect condition, however, if you do not receive your order please email us within 30 days of placing your order stating your order number.  Please note that Royal Mail do not class a package as missing until after 10 working days from the expected delivery date, therefore we cannot investigate the problem until after this period.  If the order is classed as missing by Royal Mail then we will resend the order to the original delivery address, a refund will be offered if items are out of stock. 

Laval Cosmetics are not liable for any products that arrive faulty or missing due to damaged packaging.  In the event of this happening the Customer must contact Royal Mail directly.

For orders that are returned by Royal Mail as ‘Not Called For’ we will contact the customer explaining that the order has been returned and therefore cancelled and a refund will be processed, with the deduction of postage plus a handling fee of £3.00.

Cancellation 

Customers have the right to cancel their order before it has been dispatched, given the short processing time, it is important that the customer contacts us as quickly as possible on 01925 574395.  Orders that have already been dispatched may be returned (at a cost to the customer) the refund will have the original postage cost deducted.

All prices are in GBP and are inclusive of VAT.

Customer Card payments are processed direct by ProTX/SagePay® or PayPal® depending on the option chosen by the Customer and therefore Laval Cosmetics do not have access to any of the Customer’s card details or any additional personal information used in making the payment. 

The information retained by Laval Cosmetics is solely to deliver your order and contact you with a confirmation or if there is a problem with your order.

Customers have the option to sign up to a newsletter/special offer campaign and can subscribe at any time.  We will not contact you unless you have chosen to sign up for this additional feature and we do not have any ‘pre-ticked’ boxes.
